Present:  Ms. Dean; Ms. Brymer; Mr. Bloom; Mr. Mulholland and Mr. English.  Alternate: Mr. Belden.  Also present.  George Benson, Land Use Director.  Clerk:  Ms. Wilkin

The meeting was opened at 7.35 p.m.  Notice is made that the entire meeting was taped and can be heard in the Planning and Zoning Office, 31 Pecks Lane, Newtown, Connecticut

PUBLIC HEARING  (Continued)

APPLICATION BY NICK AND GINO VONA MASON CONTRACTORS AND WF BROTHERS, LLC FOR A SEVENTEEN LOT SUBDIVISION, 46 EDEN HILL ROAD, NEWTOWN, CONNECTICUT, AS SHOWN ON THREE CERTAIN MAPS ENTITLED “PROPERTY SURVEY & SUBDIVISION MAP OF OAK RIDGE PHASE III PREPARED FOR GINO AND NICK VONA, 46 EDEN HILL ROAD, NEWTOWN, CONNECTICUT” MAPS S-1, S-2 AND S-3, DATED APRIL 12, 2007, LAST REVISED 10/17/08, SCALE 1”=60’, ASSESSOR’S MAP 12, BLOCK 2, LOT 39

A letter from Tom and Erika Reeves, 42 Oak Ridge Drive, Newtown, Connecticut dated February 19, 2009 was added to the file

James Murphy, Esq., Gregory & Adams, P.E., 10 Old Ridgefield Road, Wilton, Connecticut distributed a document entitled “Oak Ridge lll - Application for 17 Lot Subdivision – Third Public Hearing before the Newtown Planning and Zoning Commission – Thursday, February 19, 2009”.  Also a letter addressed to Ms. Dean dated February 19, 2009.  He considered the plan not to have a through road the better option.

Martin D. Malin, P.E., Tighe&Bond, Consulting Engineers, 1000 Bridgeport Avenue, Shelton, Connecticut submitted a memo from Edward Knapik, Assistant Sanitarian dated February 19, 2009

Howard Weissberg, P.E., Tighe&Bond, Consulting Engineers, 1000 Bridgeport Avenue, Shelton, Connecticut compared the traffic impact and safety issues between the two options.

Mr. Murphy asked the Commission for approval.  He would like time to digest the contents of Attorney Hall’s letter.

Ms. Dean would also like to study the contents of Mr. Hall’s letter and the comments of the Town Attorney.

Ms. Dean asked to hear from the public.

Carol Polcyn, 23 Eden Hill Road, Newtown, Connecticut would like to see the road open in order to disperse the traffic.

Mary Liscinsky, 58 Eden Hill Road, Newtown, Connecticut distributed a letter dated February 18, 2009 containing facts pertaining to the road.

Robert Hutchinson, 8 Split Rock Road, Newtown, Connecticut considered Mr. Hall’s comments at the last meeting disingenuous.

Sharon Cohen, 8 Eden Hill Road, Newtown, Connecticut had no problem with Mr. Hall’s comments adding that everything was above board.

The hearing was continued.

A recess was called at 8: 30 p.m.

The meeting reconvened at 8:40 p.m.

CORRESPONDENCE/COMMUNICATION

LAND USE DIRECTOR’S COMMENTS

Mr. Benson distributed revisions to the proposed amendment to Article V.  The Commission would discuss the matter at a future date.

At 8:41 p.m. Ms. Dean made a motion to go into Executive Session to discuss pending litigation.  Seconded by Ms. Bloom.  The vote was  unanimous

After voting to come out of Executive Session the meeting was adjourned.
